UEIL Position Paper on the MVBER

On 22 May 2025, UEIL submitted its response to the European Commission’s public consultation on the evaluation of the Motor Vehicle Block Exemption Regulation (MVBER). UEIL’s requests and suggestions for the next MVBER Regulation include:
- That the 30% market share threshold below which agreements are exempted should apply to the group rather than the individual company.
- That the hardcore restrictions eliminated in the 2010 Regulation should be reintroduced.
- An explicit statement that OEMs are likely to hold a dominant position in the aftermarket for the sale of spare parts.
- An explicit statement that OEMs in a dominant position have a special responsibility not to restrict competition.
- That the scope of the MVBER should be extended to include two-wheeled motor vehicles, off-road and construction vehicles, agricultural and forestry vehicles, and self-propelled vehicles, including tracks.
- That the new MVBER Regulation should be updated and consistent with the new provisions on repair and maintenance laid down in the 2018 RMI Regulation.
